Conformity Assessment Schemes under the Technical Regulations of the Customs Union (TR CU) 007/2011

Prior to their release into circulation, products intended for children and adolescents need to be subjected to a mandatory procedure of assessing (confirming) conformity with the requirements of the technical regulations of the Customs Union TR CU 007/2011 “On the Safety of Products Intended for Children and Adolescents” (hereinafter referred to as TR CU 007/2011). Currently, the Provision on the procedure for the use of model schemes to assess (confirm) conformity with the technical regulations of the Customs Union, approved by the Decision of the Customs Union Commission No. 621 dated April 7, 2011, is used to access conformity of products with the requirements of TR CU 007/2011.
Conformity is assessed in the form of:
· a state registration with a subsequent declaration of conformity;
· a declaration of conformity;
· certification.
If conformity of products intended for children and adolescents with the requirements of TR CU 007/2011 is assessed in the form of declaring conformity, the following schemes are used:
- 1d or 2d;
- 3d, 4d or 6d.
Schemes 1d and 2d allow to issue a declaration of product conformity according to own evidence for the following groups of products:
· leather accessories;
· school stationery.
The term of validity for this declaration of conformity is limited to 3 years.
Declarations of conformity under the schemes 3d, 4d or 6d are issued with the assistance of a third party – an accredited testing laboratory (center) – for the following groups of products:
third-layer items of clothing and other products (knitted, made from textile materials and leather) intended for children over 12 months old and adolescents;
· items of clothing, other products, and headgear made from fur and intended for children over 12 months old and adolescents;
· second-layer headgear (knitted, made from textile materials and leather) intended for children over 12 months old and adolescents;
· ready-made textile articles of clothing;
· felt footwear made from coarse wool;
· published books and magazines.
The term of validity for this declaration of conformity is limited to 5 years.
To declare conformity, the applicant needs to be a legal entity or a natural person that is a manufacturer or a seller or is acting as an overseas manufacturer under a contract with the manufacturer or seller. Schemes 1d, 3d and 6d apply to products manufactured in series, whereas schemes 2d and 4d apply to a batch of products. Scheme 6d applies if the manufacturer possesses certified management systems.
At the applicant’s request, declaring product conformity under the scheme 1d and 2d may be replaced by declaring conformity under the scheme 3d and 4d. In addition, declaring conformity may be replaced by certification under the certification schemes equivalent to the schemes for declaring conformity.
