What equipment falls within the scope of TR EEU 037/2016?

The Technical Regulations of the Eurasian Economic Union “On Restricting the Use of Hazardous Substances in Electrical and Electronic Products” (TR EEU) 037/2016 (hereinafter referred to as TR EEU 037/2016) establish mandatory requirements concerning the presence of hazardous substances in electrical and electronic products.

The scope of TR EEU 037/2016 includes the following: electrical devices and household appliances; computers and devices that may be connected to them; telecommunications facilities; copy machines and other electrical office equipment; power tools; light sources and lighting equipment; electric musical instruments; game machines and vending machines; cash registers, automated teller machines and interactive kiosks; cables, wires, and power cords; circuit breakers and residual-current devices; smoke detectors.

The scope of the abovementioned Technical Regulations does not include the following:

- electrical and electronic products intended for use at a nominal voltage of over 1,000 V of alternating current and over 1,500 V of direct current;

- products intended for use as components;

- electric toys;

- solar batteries that are components of electrical products;

- products intended for space objects;

- products intended for use in air transportation, on waterborne, land and underground transport;

- electric batteries and accumulators;

- products that have been in use;

- measuring equipment;

- medical products.

 

What are the regulations concerning market circulation?

An electrical and electronic product is released into market circulation in member states of the Eurasian Economic Union (hereinafter referred to as the Union) if it complies with the requirements of TR EEU 037/2016, as well as other Union’s technical regulations which it is subject to. Every unit of an electrical and electronic product needs to be marked with the Eurasian Conformity mark.

 

What requirements are established concerning restrictions on the use of hazardous substances?

An electrical and electronic product should be designed and manufactured in such a way that it contains none of the following:

- hazardous substances, such as: lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls, and polybrominated diphenyl ethers;

- homogenous materials containing abovementioned hazardous substances at a concentration exceeding the acceptable level.

In addition, specific requirements apply to particular electrical and electronic products, restricting the use of hazardous substances in products and their components.



What are the requirements concerning marking, as well as instruction manuals?

An electrical and electronic product should be marked with the following: the name and (or) identification and (or) trademark of the manufacturer; key product features and characteristics; name of the manufacturing country. The marking should be legible, easy to read and applied in a place available for inspection.

If it is impossible to apply this information directly onto the products, it may be specified in the instruction manuals accompanying this equipment.

The instruction manuals should contain the following:

- information applied onto the product (specified above);

- information on the function of the product;

- product characteristics and features;

- rules and conditions for product use, assembly, storage, commercial transportation (transportation by own means), marketing, and disposal (applicable rules, if required);

- information on steps to be taken in the event of product malfunction;

- name and location of the manufacturer (the authorized person of the manufacturer), the importer, and their contact information;

- information on the month and year of manufacture for the product and (or) on the location where this information was applied, or on ways of determining the year of manufacture.

Instruction manuals should be made in Russian and, if subject to corresponding legal requirements of EEU member states, in the official language (official languages) of the member state in the territory of which the product is marketed.




How do I ensure and confirm the compliance with requirements concerning the use of restricted substances?

The compliance of an electrical and electronic product with TR EEU 037/2016 is ensured by its meeting the Regulations’ requirements concerning restrictions on the use of hazardous substances. Methods for examination (testing) and product measurement are determined by standards included in the List of Standards containing the rules and methods for examination (testing) and measurement, including sampling rules necessary to apply and fulfill the requirements of TR EEU 037/2016.

Electrical and electronic products included in the List in accordance with Appendix 1 to TR EEU 037/2016 are subject to a conformity assessment (confirmation) in the form of declaring conformity. The List contains various electrical devices and household appliances; personal computers and particular devices that may be connected to them; electric heat tools and electric musical instruments; cables, wires, power cords, and various equipment for commutation distribution and control (circuit breakers, residual-current devices, electric fuses, starters, etc.).

Based on the decision of the manufacturer (the authorized person of the manufacturer) or the importer, conformity assessment (confirmation) with the requirements of TR EEU 037/2016 for electrical and electronic products subject to conformity assessment (confirmation) through submitting a declaration may be replaced by a conformity assessment (confirmation) in the form of certification.




What are the requirements for product marking with the Eurasian Conformity mark?

An electrical and electronic product conforming to the requirements of TR EEU 037/2016 and having completed a conformity assessment procedure in accordance with Section VII of these Technical Regulations should have the Eurasian Conformity mark. The Eurasian Conformity mark is applied to every unit of an electrical and electronic product in a way that ensures a clear and distinct image throughout the entire service life of the product. The Eurasian Conformity mark is applied onto the product, its packaging and the instruction manuals accompanying this product.
